1. Introduction

This Privacy Policy explains how we collect, use, store, and protect your personal data when you use the TopSende iOS and watchOS application (the “App”) and this website (the “Site”), operated by TopSende.

TopSende is designed for indoor football (futsal) matches: you can record heart rate, distance, and scores on Apple Watch during a match and review results on the paired iPhone app.

By using the App or Site, you confirm that you have read and understood this policy. If you do not agree, please do not use the App.

2. Data controller

For users in Turkey, TopSende is the data controller under the Turkish Personal Data Protection Law (KVKK). For users in the European Economic Area and UK, we act as the controller under applicable data protection laws (including the GDPR where it applies).

3. Data we collect

Depending on how you use the App, we may process the following categories of data:

3.1. Account and profile

• Display name or username
• Email address or phone number (if you create an account or sign in)
• Profile photo or content you choose to upload

3.2. Health and activity data

• Heart rate during matches (e.g. via Apple Health / HealthKit, with your permission)
• Distance covered during matches
• Match-related activity and workout data from Apple Watch

Health and fitness data is sensitive. We only access it when you grant permission on your device and only for features you use.

3.3. Match and app usage data

• Scores and match events you enter on Apple Watch
• Match history, statistics, and preferences
• App settings and in-app interactions

3.4. Technical data

• Device model, operating system version, app version, language
• Crash reports, performance logs, and diagnostic data
• IP address and approximate location derived from network infrastructure

3.5. Permissions-based data

Only when you use a feature and approve the system permission: notifications, location, camera, photo library, or other Apple system permissions required by that feature.

3.6. Website

This Site provides static information pages. We do not require account registration on the Site. Our hosting provider may keep standard server logs (IP address, browser type, access time).

4. How we use your data

• Provide, maintain, and improve the App and match tracking features
• Sync data between Apple Watch and iPhone
• Authenticate accounts and protect security
• Respond to support requests
• Detect errors and improve performance
• Comply with legal obligations and protect our rights
• Send marketing communications only where permitted by law and with your consent (if applicable)

5. Legal bases

We process personal data based on one or more of the following, as applicable:

• Performance of a contract (providing the App and its features)
• Your consent (e.g. optional notifications, HealthKit access, certain permissions)
• Legitimate interests (security, service improvement, fraud prevention)

Where GDPR applies, you may withdraw consent at any time without affecting the lawfulness of processing before withdrawal.

• Apple (App Store, HealthKit, Watch connectivity, and related platform services)

If service providers are located outside your country, we ensure appropriate safeguards (such as standard contractual clauses, adequacy decisions, or your consent where required by law).

We keep personal data only for as long as needed for the purposes described in this policy or as required by law. When you delete your account, we delete or anonymise data within a reasonable period, except where we must retain it for legal reasons.

9. Security

We use technical and organisational measures such as encryption, access controls, and secure communication to protect your data. No system is completely secure; we work continuously to reduce risk.

10. Children

The App is not directed at children under 13. We do not knowingly collect personal data from children under 13. If you believe we have done so, contact bakiylmazer@gmail.com and we will delete the data.

Depending on your location, you may have the right to:

• Restrict or object to certain processing

12. Apple App Store and HealthKit

The App is distributed via the Apple App Store. Apple’s own privacy practices are described in the Apple Privacy Policy. Health data accessed through HealthKit is used according to Apple’s rules and only for the purposes disclosed in the App and in App Store Connect privacy labels, which must stay consistent with this policy.

13. Changes to this policy

We may update this policy from time to time. We will post the effective date on this page. Continued use of the App after changes means you accept the updated policy.
